Legal Tip: What Makes a Legal Description?
A legal description is a way to identify a piece of property. On a Warranty Deed it is the description right underneath the parties who are receiving the land. Tennessee law states that a legal description is adequate if a surveyor would be able to identify the property with the information given.
When drawing up a contract a legal description include the lot, plat book, and page number or a metes and bounds description as this is the most accurate way to identify the property. This is always preferred over a map and parcel or a street address as those can be misleading.
However, if the only information you have is the map and parcel or the street address they are helpful for us to identify the property, just make sure to call us after you send us the contract to verify the description, especially if your buyers are purchasing land.
