Legal Tip: Types of Deeds
Over the last several weeks we’ve discussed how real property can be vested in one or more people. The next topic will cover the different kinds of documents which transfer the property. This Document is known as a Deed.
Have you ever read the top of a Deed? The name of the Deed tells what promises the owners are giving to the new buyers. The three most common Deeds used to transfer ownership are: General Warranty Deeds, Special Warranty Deeds, and Quit Claim Deeds.
Each type is useful in a unique way. General Warranty Deeds are most common in every day sales, while Special Warranty Deeds are often used by Builders. Quit Claim Deeds are most common in quick transfers between family members or to add someone else to title.
Starting next week we will dive into each of these individually and also introduce a few other lesser known, but also useful Deeds
