First you need to ask the sellers if there is a will. If there is a will then it is known as a testate estate. If there is not a will it is an intestate estate. This week we will talk about what to do if there is a will.

Ask your seller if the will has been probated. A probated will is a will that has been brought before the court and the court has opened up an estate for the deceased. You will then need to find out who is the executor of the estate.

The executor of the estate is the person appointed by the court to handle the estate’s affairs. Ask the seller who their estate attorney is and send in the attorney’s contact information when you send us the contract.

By making us aware of the estate early on in the process we will be able to talk to the estate attorney and ensure the process of the sale is as smooth as possible for all parties involved.
